Terms of Service for Pixel And Packs

Effective Date: March 8, 2026

Welcome to Pixel And Packs (“the Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and Pixel And Packs, governing your access to and use of our physical storefront located at 477 W Irving Park, Bensenville, IL 60106, and our digital platform, pixelandpax.com (the “Site”).

By purchasing products, entering our establishment, or navigating our Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of our services.

1. General Conditions and Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks to facilitate the technical requirements of connecting networks or devices.

2. Accuracy of Product and Pricing Information

While we strive for absolute precision, Pixel And Packs does not warrant that product descriptions, photographs, or pricing on pixelandpax.com are error-free.

 

  • We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

     

  • Prices for our products are subject to change without notice.

3. Trading Card Game (TCG) Specific Provisions

The TCG market is subject to extreme price volatility. By purchasing TCG products from us, you acknowledge and agree to the following specialized conditions:

  • Market Fluctuation: We do not offer price protection or price matching. If the market value of a card or sealed product changes after your purchase, the original sale price remains final.

  • Authenticity and Condition: We go to great lengths to verify the authenticity of all Raw and Graded cards. Once a product has left our custody (either by exiting the Bensenville store or being delivered by a carrier), Pixel And Packs is not responsible for any subsequent damage or claims of non-authenticity.

4. Return and Exchange Policy (The "30-Day Rule")

Our return policy is strictly enforced to protect the integrity of our inventory:

  • Standard Merchandise: Returns and exchanges are allowed within 30 days of purchase, provided the items are in original, unused condition with a valid receipt.

  • TCG Final Sale Exception: As stated in our primary policy, all TCG products—including individual Raw cards, Graded cards, and all Sealed products—are FINAL SALE. These items are not subject to return, refund, or exchange under any circumstances.

5. Prohibited Uses of Services

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others (including TCG brand trademarks).

  • To submit false or misleading information regarding "damaged" goods to circumvent our Final Sale policy.

6. Limitation of Liability and Indemnification

Pixel And Packs, our directors, employees, or affiliates shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of any of our products. You agree to indemnify and hold Pixel And Packs harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms.

7. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any legal action or proceeding related to your access to, or use of, the Site or our Bensenville location shall be instituted in a state or federal court in DuPage County, Illinois.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
